The employer keeps a staff register by establishment as soon as the first employee is hired (or as soon as a trainee arrives). The first and last names of all employees are listed in the order in which they were hired. These entries are entered in the register at the time of employment and indelibly.

The absence of a register, the absence of an update or the omission of mandatory information can result in a fine of up to 750€ per employee concerned.

The law of December 14, 2020 on the financing of social security for 2021 announced the abolition of the paper register in favor of a digital register. However, to date, no regulatory text has imposed the dematerialized keeping of said register. However, it is strongly recommended pending this upcoming regulation.

Article D441-2 of the Social Security Code provides for the possibility for the employer to keep this register available to authorized persons “on the medium of its choice”, as long as it is durable and unalterable. This is the case with digital media.
